This Privacy Policy (“Agreement”) applies to the smartphone application (“Application”) and website (“Website”) provided by INFORMU, INC. (“Company,” “we,” “us,” or “our”). Company provides artificial intelligence personal assistance that understands your intentions, without typing or talking, by calling service providers’ APIs (collectively, “Service” or “Services”). The Company values your privacy and is committed to maintaining your trust. We provide this Agreement to inform you of our policies and procedures regarding the collection, use, and disclosure of your Personal Information that is obtained from third parties or received from Users (“you,” “your,” or “User”) of this Application and all of the Company’s other Products and/or Services, website, and other online services that post a link to this Agreement.

General Data Protection Regulation

The processing of Third Party Personal Information or Personal Information that is voluntarily supplied by you shall always be in line with the General Data Protection Regulation (“GDPR”), and in accordance with the country-specific data protection regulations applicable to the Company. Specifically, European Union (“EU”) data subjects are informed of the rights to which they are entitled and the recourse they may seek if they have any questions regarding the collection, use, and processing of their Personal Information by the Company.

Your Privacy Rights under the GDPR

The GDPR includes the following rights for EU data subjects:

Data Protection Officer

The Company appoints Tom Daniel as the Data Protection Officer (“DPO”). The DPO will be responsible for all Company data protection compliance activities and can answer any questions you may have about your Personal Information. The DPO may be reached at team@informu.io.

Data Controller

The Company is the legal entity which determines the purpose and means of the processing of Personal Information. The Company is responsible for collecting your consent, managing consent-revoking, and enabling right to access. If you wish to revoke consent for us to store, use, or share your Personal Information, you may contact the DPO.

Data Processor

The Company is the legal entity which processes your Personal Information. The Company has not retained any third-party service provider to process your Personal Information. If you have questions regarding the processing of your Personal Information, you may contact the DPO.

Data Protection Authority (DPA)

The Company has identified the Data Protection Commission (“DPC”) in Ireland as its DPA. The DPC, in coordination with the DPO, oversees Company data processing activities.

Breach

The Company will notify you of a Personal Information breach without undue delay, and within 72 hours if feasible, after becoming aware of the breach.

Data Retention/Erasure

We will retain your Personal Information for as long as needed to provide the applicable Services, or for a minimum of four (4) years. If you wish for us to erase your data, please make a request to the Company at team@informu.io.

Our Response to Your Requests

If you make any requests regarding your Personal Information, we will not charge you for compliance. The Company will respond and comply within one month.

Complaints

Every EU data subject shall have the right to lodge a complaint with a DPA, in particular in the Member State of their habitual residence, place of work or place of the alleged infringement.

Data Protection Impact Assessment (DPIA)

Any company whose data processing is likely to result in a high risk to data subjects should perform a Data Protection Impact Assessment (“DPIA”). The Company voluntarily elects to provide interested persons with a DPIA summary.

Our use of your Personal Information is based on the following legitimate business grounds:

  • The use is necessary in order to fulfill our commitments to you;
  • The use is necessary for compliance with a legal obligation;
  • The use is necessary in order to protect your vital interests;
